Wage, Hour & Overtime Laws

The law requires that any non exempt individuals who work by the hour be paid for the time they work. The minimum wage rate is $7.25 per hour in Pennsylvania.

However for commissioned work such as waiters or waitresses that include tips the minimum wage is $2.83 per hour as long as your tips cover the national non exempt hourly rate of $7.25.

If you are waiter or waitress and you only made $10 in tips on a 8 hour shift, it is the business owners responsibility to make up the difference from the standard $2.83 per hour you should be getting for such employment.

EXAMPLE: Waitress Or Waiter Position
8 HR Shift @ $2.83 PH = $22.64 + $10 in Tips = $33.64
8 HR Shift @ $7.25 PH = $58.00
Business Owner Must Make Up The Difference If The Employee Falls Short On Tips.
In this case the difference is $24.36
